Save to the extent required by law the NLA does not make any warranty or representation that the Content is accurate, complete, or fit for any particular purpose. To the fullest extent permitted by law the NLA on behalf of itself, its directors, employees, agents and other representatives excludes any liability for any losses or damages whatsoever arising out of or in connection with the use of the Site, even if the NLA or any of its directors, employees, agents or other representatives had been advised of the possibility of any loss or damage.
Notwithstanding anything in these Terms the NLA does not exclude or limit its liability for:
• Death or personal injury caused by the NLA’s negligence
• Fraudulent misrepresentation
• Any other liability that it is unlawful to exclude
The NLA is the owner or licensee of all intellectual property rights in the Site and the Content.
User must act lawfully at all times in accessing and using this Site. User must not use this Site in any manner, or upload any material or link to any material, which is offensive, obscene, defamatory, fraudulent, misleading or in any way infringes any third party rights. User must not restrict any other person’s right to freely use this Site.
Except with the prior written consent of the NLA User may only copy or print Content for personal, non-commercial use.
User may not create a link to any part of this Site without the prior written consent of the NLA nor create a frame or other browser or border around the Site.
If User applies for an NLA licence on the Site User must not use any false details or impersonate another person.
Where any usernames, passwords or other log-in details are provided to User to access or use any part of the Site (‘Secure Area’) User undertakes to keep such information confidential and secure and not share it or allow any third party to use such information to access the Secure Area. User must immediately notify the NLA in the event that User becomes aware of any unauthorised use of the Secure Area and / or any breach of confidentiality.
The NLA does not accept any responsibility for any third party websites to which hyperlinks are included on the Site, access to which are entirely at User’s own risk.
User agrees to keep the NLA indemnified from and against any loss or damage caused by any breach by User of these Terms and / or of any statutory duty.
The NLA reserves the right to suspend or terminate User’s access to this Site in the event that it reasonably believes User is in breach of any of these Terms.
In the event that any provision contained in the Terms is or becomes illegal, invalid, and/or unenforceable for any reason then such provision shall to the extent required be severed from the Terms and rendered ineffective so far as possible without modifying the remaining Terms and shall in no way affect the validity or enforceability of any other provision.
No failure or delay by the NLA in enforcing any breach of the Terms shall be deemed a waiver of any of the NLA’s rights or constitute a waiver of any preceding or subsequent breach of the Terms.
Nothing in the Terms shall be construed as creating a partnership or joint venture between User and the NLA.
No person other than User and the NLA shall have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce the Terms.
Any rights granted under the Terms are personal to User and may not be assigned or transferred without the prior written consent of the NLA.
The Terms and your use of the Site shall be governed and construed in accordance with English Law and subject to the jurisdiction of the English Courts.
